The Appeals Court had ruled that the International Emergency Economic Powers Act (1977), did not grant the broad powers which the Trump administration was claiming. This decision did not affect some specific tariffs, such as steel or aluminum which were increased under other presidential authority. On February 20, 2026, the Supreme Court decided in Learning Resources, Inc. v. Trump that the IEEPA did not authorise the president to impose tariffs.
